1. Participation & Acknowledgement of Risk

1.1 I, the undersigned, am participating in this trip organized by The Golden Opportunities Ziaraat Group (hereafter “The Organizer”) voluntarily and at my own risk.

1.2 I understand that the trip may involve travel by air, bus, car, train, boat, or on foot, and may expose me to risks including — but not limited to — illness, injury, death, political unrest, pandemics, poor road or facility conditions, and loss or damage to personal belongings.

1.3 I accept and assume all risks — whether foreseeable or unforeseeable — associated with this journey, and waive any liability from The Organizer, its agents, representatives, scholars, sponsors, or affiliates.

1.4 I understand that this trip includes visits to countries with fluctuating safety, infrastructure, or government regulations, and I am solely responsible for ensuring I meet all visa, vaccine, or entry requirements.

1.5 I understand there may be last-minute delays, schedule changes, route deviations, or cancellations due to unforeseen circumstances (e.g. weather, government orders, road closures, strikes, or war). I will not hold The Organizer liable for inconvenience, cost, or loss caused by such disruptions.

1.6 I acknowledge the recommendation to purchase comprehensive travel insurance that includes medical coverage, trip interruption, lost luggage, and emergency evacuation.

1.7 I understand that while The Organizer takes reasonable safety and logistic precautions, it cannot guarantee a risk-free environment in cities such as Najaf, Karbala, Kadhmain, Samarra, Mashhad, or Medina.

2. Health & Fitness

2.1 I confirm that I am medically and physically fit to travel and participate in the activities. I will disclose any medical conditions, allergies, or limitations to The Organizer in advance.

2.2 I am responsible for carrying all necessary medications and any documentation needed for medical care abroad.

2.3 I agree to follow all safety instructions, group guidelines, and local laws and customs. Failure to comply may result in removal from the group trip at my expense.

3. Liability Waiver & Indemnity

3.1 I (and my heirs, executors, administrators, and assigns) unconditionally release, discharge, and agree to indemnify and hold harmless The Organizer, its affiliates, directors, employees, volunteers, scholars, and subcontractors from any and all claims, liability, loss, or expense resulting from injury, death, loss, or damage incurred during the trip — even if due to negligence or unforeseen conditions.

3.2 This waiver applies to myself and all persons traveling under my registration, including minors, family members, or dependents.

3.3 If any part of this agreement is deemed unenforceable under law, the remaining terms shall remain in full effect. This agreement shall be interpreted in accordance with the laws of Canada, Iraq, and any jurisdiction relevant to the Organizer’s operations.

4. Payment & Refund Policy

4.1 A non-refundable deposit of $200 USD (per segment) is required at the time of registration. This secures your place but does not guarantee all services until final payment is received.

4.2 If you cancel after paying the deposit, the refund (if any) will depend on unrecoverable expenses already incurred on your behalf, including hotel bookings, visa processing, and transportation deposits.

4.3 Full payment is typically due 30 days prior to departure unless otherwise communicated. Failure to pay may result in cancellation of your spot without refund.

4.4 Payments may be made in CAD, USD, or via bank transfer as instructed. Currency fluctuations, bank fees, and exchange rates are the responsibility of the traveler.

4.5 The Organizer reserves the right to cancel the trip due to insufficient registrations or force majeure (natural disasters, political unrest, etc.). In such cases, we will attempt to refund recoverable costs, but cannot guarantee full reimbursement.

5. Media Release

5.1 I grant The Organizer permission to use photographs, audio, and video taken of me during the trip for marketing, promotional, and archival purposes, unless I explicitly request otherwise in writing before the trip begins.

6. Minors & Group Behavior

6.1 All minors must be accompanied by a legal guardian. Parents or guardians assume full responsibility for their children’s behavior, safety, and participation.

6.2 Disruptive, unsafe, or disrespectful behavior may result in removal from the group without refund.

By signing this agreement, I acknowledge that I have read, understood, and agreed to the above Terms & Conditions and that I am participating willingly.
